Environmentalists Sue Feds Over Fracking

Three environmental groups filed suit today against the Delaware River Basin Commission over natural gas drilling regulations. The groups want the DRBC to conduct an environmental impact study of gas drilling within the Delaware River watershed. The Delaware Riverkeeper, the National Parks Conservation Association and the New York based Riverkeeper say that the DRBC and the Army Corps of Engineers failed to compy with the National Environmental Policy Act when they proposed gas drilling regulations before conducting the impact study.
The New York Attorney General also filed a similar suit in May. But this week the U.S. Attorney asked a federal judge in Brooklyn to dismiss it based on the “sovereign immunity” held by the federal government.
