The ban passed with nearly 59 percent of the vote.<\/p>\n<p>Many in Denton worry about how fracking and associated\u00a0activities\u00a0impact their health and quality of life. \u00a0But opponents say\u00a0the ban is\u00a0bad for the economy. The drilling industry, which<a style=\"font-size: 14px;\" href=\"http:\/\/www.theguardian.com\/environment\/2014\/nov\/05\/birthplace-fracking-boom-votes-ban-denton-texas\"> pumped hundreds of thousands of dollars<\/a> into the campaign against the ban, is concerned with the precedent Denton could set for other Texas towns.<\/p>\n<p>Just hours after the vote, the<a href=\"https:\/\/www.txoga.org\/\"> Texas Oil and Gas Association <\/a>(TxOGA) filed a legal challenge to the ban, as did the Texas General Land office<a href=\"http:\/\/www.star-telegram.com\/2014\/11\/05\/6263444\/texas-energy-industry-sues-denton.html\">\u00a0with a suit<\/a>.<\/p>\n<p>There may be more legal challenges on the way.<\/p>\n<p>The TxOGA lawsuit asserts that\u00a0&#8220;the public policy of Texas is to encourage the full and effective exploitation of our mineral resources,&#8221; says Tom Phillips, a lawyer with <a href=\"http:\/\/www.bakerbotts.com\/\">Baker Botts<\/a> who is working on the challenge.<\/p>\n<p><!--more-->&#8220;The Texas legislature has passed a number of statutes giving [state regulators] the right and the\u00a0duty\u00a0to pass rules and regulations regarding hydraulic fracturing,&#8221; Phillips says, &#8220;because of that assumption of power by the state, no city has the right to totally ban hydraulic fracturing within the city limits.&#8221;<\/p>\n<div class=\"related-content alignleft\"><h4 class=\"related-header\">Related<\/h4><div class=\"links\"><h5>Posts<\/h5><ul><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/texas\/2014\/11\/05\/voters-cast-ballots-in-first-ever-push-to-ban-fracking-in-texas\/\">Voters Pass First Local Fracking Ban in Texas<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/texas\/2014\/04\/08\/what-a-fracking-ban-in-denton-could-mean-for-texas\/\">What a Ban on Fracking in Denton Could Mean For the Rest of Texas<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/texas\/2014\/11\/04\/amid-oil-boom-texas-votes-on-who-holds-the-reigns-of-regulation\/\">Amid Oil Boom, Texas Votes On Who Holds the Reins of Regulation<\/a><\/li><\/ul><\/div><div class=\"topics\"><h5>Topics<\/h5><p class=\"topic\"><img class=\"alignleft\" src=\"http:\/\/stateimpact.npr.org\/texas\/files\/2014\/04\/11759123_H25604995.jpg\" height=\"60\" width=\"60\" \/><a href=\"http:\/\/stateimpact.npr.org\/texas\/topic\/denton\/\">How the Denton Fracking Ban Could Work<\/a><\/p><\/div><\/div>\n<p>TxOGA is seeking a temporary injunction on the ban before it goes into effect. Even before the ban passed, Denton mineral rights owners were considering lawsuits of their own.<\/p>\n<p>&#8220;We have a right to develop our minerals, and if you vote to not frack, you can&#8217;t develop your minerals,&#8221; Bobby Jones, a local mineral rights owner and campaigner against the ban told StateImpact Texas last month. &#8220;It&#8217;s gonna devalue land.&#8221;<\/p>\n<p>Jones says many people expected the state of Texas to either file suit against the ban, or for lawmakers to pass legislation to end it.<\/p>\n<p>&#8220;I would say the first move would be to see what the state of Texas is going to do with the city of Denton,&#8221; said Jones, &#8220;then if that doesn&#8217;t go anywhere, they better get ready for a bunch of mineral owners to file lawsuits &#8230; They&#8217;ll have to pay them off,&#8221; said Jones.<\/p>\n<p>The lawsuits Jones is referring to are different from the kind filed by TxOGA. They would assert that the ban represents a taking of mineral rights owners&#8217; private property. If those challenges are successful, the city may have to pay off mineral rights owners for blocking access to their natural gas.\u00a0&#8220;It won&#8217;t be pretty, I don&#8217;t think,&#8221; Jones added.<\/p>\n<p>&#8220;Those [takings challenges] are premature at this point,&#8221; Baker Botts&#8217; Phillips says. &#8220;I would think because the law hasn&#8217;t come into effect, and therefore nothing&#8217;s been taken.&#8221;<\/p>\n<p>Even if that&#8217;s the case, the prospect of multiple lawsuits and the money they would cost has \u00a0supporters of the ban concerned.<\/p>\n<p>&#8220;I spoke to a lawyer about what it&#8217;s going to look like when the ban passes, and he said &#8216;It\u00a0depends\u00a0on how\u00a0vigorously your city defends the ban,'&#8221; said pro-ban activist Cathy McMullen, also before the vote.<\/p>\n<p>&#8220;With our issue with the way that the [gas[ wells were permitted, I feel that the courts are the only solution &#8212; that&#8217;s the only solution that we have,&#8221; she said. &#8220;I welcome the lawsuits because at least somebody is paying attention to what we&#8217;re saying.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This week Denton, Texas became the first city in the state to ban fracking within its city limits.
