{"id":36310,"date":"2014-04-30T09:46:02","date_gmt":"2014-04-30T14:46:02","guid":{"rendered":"http:\/\/stateimpact.npr.org\/texas\/?p=36310"},"modified":"2014-04-30T09:46:02","modified_gmt":"2014-04-30T14:46:02","slug":"sierra-club-worried-about-precedent-from-nuclear-waste-site-ruling","status":"publish","type":"post","link":"https:\/\/stateimpact.npr.org\/texas\/2014\/04\/30\/sierra-club-worried-about-precedent-from-nuclear-waste-site-ruling\/","title":{"rendered":"Sierra Club Worried about Precedent from Nuclear Waste Site Ruling"},"content":{"rendered":"<h4><\/h4>\n<div id=\"attachment_26890\"  class=\"wp-caption module image right\" style=\"max-width: 300px;\"><a class=\"fancybox\" title=\"The new ruing could make it more difficult to contest similar projects in the future. \" href=\"http:\/\/stateimpact.npr.org\/texas\/files\/2013\/04\/11819642_H20487791.jpg\" rel=\"\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-26890\" alt=\"The new ruing could make it more difficult to contest similar projects in the future. \" src=\"http:\/\/stateimpact.npr.org\/texas\/files\/2013\/04\/11819642_H20487791-300x193.jpg\" width=\"300\" height=\"193\" srcset=\"https:\/\/stateimpact.npr.org\/texas\/files\/2013\/04\/11819642_H20487791-300x193.jpg 300w, https:\/\/stateimpact.npr.org\/texas\/files\/2013\/04\/11819642_H20487791-620x400.jpg 620w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p class=\"wp-media-credit\">Photo by REUTERS \/SUZANNE PLUNKETT\/LANDOV<\/p><p class=\"wp-caption-text\">The new ruing could make it more difficult to contest similar projects in the future.<\/p><\/div>\n<h4><a href=\"http:\/\/kxwt.org\/sierra-club-worried-about-precedent-from-nuclear-waste-site-ruling\/\"><em>From KXWT:<\/em><\/a><\/h4>\n<p>A state appeals court has again upheld a radioactive waste license for a storage site in Andrews County.<\/p>\n<p>The site is owned and operated by\u00a0<a href=\"http:\/\/www.wcstexas.com\/\" target=\"_blank\">Waste Control Specialists,<\/a>\u00a0and it\u2019s been at the middle of\u00a0<a href=\"http:\/\/www.texastribune.org\/2012\/10\/21\/texas-sierra-club-fights-wcs-radioactive-waste-sit\/\" target=\"_blank\">a series of legal challenges<\/a>\u00a0from the\u00a0<a href=\"http:\/\/texas.sierraclub.org\/\" target=\"_blank\">Lone Star Chapter<\/a>\u00a0of the Sierra Club.<\/p>\n\n<p>We recently spoke with the\u00a0<strong>Sierra Club\u2019s Conservation Director Cyrus Reed,<\/strong>\u00a0who says the group\u2019s worried about the precedent\u00a0<a href=\"http:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=75240893-d744-4bb7-8db8-50762d46390b&amp;coa=coa03&amp;DT=Opinion&amp;MediaID=6fd344a9-a052-4f5a-ab10-a3e79231d96d\" target=\"_blank\">the ruling<\/a>\u00a0could set for other citizens or groups hoping to oppose similar licenses.<!--more--><\/p>\n<p>The environmental group has been trying to get the state to reverse its permit for WCS for years, mainly because the group was upset that state regulators never gave it a chance for what\u2019s called a\u00a0<a href=\"http:\/\/www.tceq.state.tx.us\/assets\/public\/legal\/rules\/rules\/pdflib\/55g.pdf\" target=\"_blank\">\u201ccontested case hearing\u201d<\/a>\u00a0\u2013 basically a courtroom-style public hearing where citizens and groups can challenge license proposals.<\/p>\n<p>Since the group\u2019s initial lawsuit in 2007, the courts have said the\u00a0<a href=\"http:\/\/www.tceq.state.tx.us\/\" target=\"_blank\">Texas Commission on Environmental Quality<\/a>\u00a0did have the right to deny the group a contested hearing.<\/p>\n<p>A state appeals court shot down one of the Sierra Club\u2019s challenges to the waste site\u00a0<a href=\"http:\/\/marfapublicradio.org\/blog\/court-thwarts-sierra-clubs-radioactive-waste-challenge\/\" target=\"_blank\">earlier this month,<\/a>\u00a0and now that court has again ruled in favor of the TCEQ.<\/p>\n<p>This latest ruling upholds the the Andrews County company\u2019s\u00a0<a href=\"https:\/\/www.tceq.texas.gov\/permitting\/radmat\/licensing\/wcs_license_app.html\" target=\"_blank\">license to store low-level radioactive waste,<\/a>\u00a0the type that\u2019s been\u00a0<a href=\"http:\/\/marfapublicradio.org\/blog\/bound-for-carlsbad-diverted-nuclear-waste-arrives-in-west-texas\/\" target=\"_blank\">arriving in West Texas<\/a>\u00a0by the truckload from a shuttered storage site in New Mexico since early April.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>From KXWT: A state appeals court has again upheld a radioactive waste license for a storage site in Andrews County.
