The ruling, which could have<a href=\"http:\/\/stateimpact.npr.org\/texas\/2013\/03\/12\/ruling-on-water-policy-could-be-felt-across-the-state\/\"> implications for the water management across the state<\/a>, said the Texas Commission on Environmental Quality (TCEQ)\u00a0was responsible for the deaths of 23 rare Whooping Cranes. It prohibited the TCEQ from issuing new water use permits for the Guadalupe and San Antonio River unless the Agency could prove that the cranes would not be impacted.<\/p>\n<p>Today, the Texas Attorney General said the state would appeal that ruling, and sought an emergency stay from the federal district court while the state plans that appeal.<\/p>\n<p><!--more-->A <a href=\"https:\/\/www.oag.state.tx.us\/oagnews\/release.php?id=4329#.UUNLqvq62GY.twitter\u00a0\u2026\">statement<\/a> from the Attorney General&#8217;s office says the ruling &#8220;exceeded its lawful authority&#8221; and &#8220;could cause severe economic harm to the State and impose drastic federal regulations on the farms, ranches and communities along the Guadalupe and San Antonio Rivers.&#8221;<\/p>\n<p><!--[if lt IE 9]><script>document.createElement('audio');<\/script><![endif]-->\n<audio class=\"wp-audio-shortcode\" id=\"audio-25400-1\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/stateimpact.npr.org\/texas\/files\/2013\/03\/web-Buchele-AG-Fights-Whooping-Crane-Ruling-MIX.mp3?_=1\" \/><a href=\"https:\/\/stateimpact.npr.org\/texas\/files\/2013\/03\/web-Buchele-AG-Fights-Whooping-Crane-Ruling-MIX.mp3\">https:\/\/stateimpact.npr.org\/texas\/files\/2013\/03\/web-Buchele-AG-Fights-Whooping-Crane-Ruling-MIX.mp3<\/a><\/audio>The AG&#8217;s Office also said that U.S. District Judge Janis Graham Jack &#8220;incorrectly faulted&#8221; the TCEQ in the birds&#8217; deaths.<\/p>\n<p>The move doesn&#8217;t come as a surprise. In the immediate aftermath of Judge Jack&#8217;s ruling, the TCEQ said it would &#8220;seek relief from the court\u2019s action enjoining the agency from approving or granting new water right permits.&#8221;<\/p>\n<p>The agency also said it was &#8220;considering&#8221; an appeal of the case.
