Today, an appeals court in Washington has <a href=\"http:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/19346B280C78405C85257A61004DC0E5\/$file\/11-1302-1390314.pdf\">ruled that the EPA violated the Clean Air Act<\/a> with its Cross-State Air Pollution Rule (CSAPR), and now must revise the ruling.<\/p>\n<p>It&#8217;s welcome news for Abbott, who just last week bragged that he likes to &#8220;<a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/08\/15\/what-does-the-texas-attorney-general-do-for-fun-sue-the-obama-administration\/\">sue the Obama administration<\/a>&#8221; for fun. The state of Texas was joined by dozens of others, including some Texas power companies, in challenging the rule. Abbott quickly tweeted this:<\/p>\n<blockquote class=\"twitter-tweet\"><p><a href=\"https:\/\/twitter.com\/search\/?q=%23EPA\"><s>#<\/s><strong>EPA<\/strong><\/a> overlords suffer another defeat to <a href=\"https:\/\/twitter.com\/search\/?q=%23Texas\"><s>#<\/s><strong>Texas<\/strong><\/a>: The power to regulate is the power to destroy. <a title=\"http:\/\/bit.ly\/ShfBYc\" href=\"http:\/\/t.co\/e72BepcV\">bit.ly\/ShfBYc<\/a><a href=\"https:\/\/twitter.com\/search\/?q=%23txlege\"><s>#<\/s><strong>txlege<\/strong><\/a><a href=\"https:\/\/twitter.com\/search\/?q=%23tcot\"><s>#<\/s><strong>tcot<\/strong><\/a><\/p>\n<p>\u2014 Greg Abbott (@GregAbbott_TX) <a href=\"https:\/\/twitter.com\/GregAbbott_TX\/status\/237930659132362754\" data-datetime=\"2012-08-21T15:14:24+00:00\">August 21, 2012<\/a><\/p><\/blockquote>\n<p>The <a href=\"http:\/\/www.epa.gov\/airtransport\/basic.html\">proposed rules<\/a> (you can <a href=\"http:\/\/www.epa.gov\/airtransport\/\">read more about them here<\/a>) would limit pollution (sulfur dioxide and nitrogen oxide) from older coal power plants that ends up in other states. The rule would apply to 28 states, and would utilize a cap-and-trade system for the plants to come into compliance. Under this\u00a0cooperative federalism approach, both the Federal\u00a0Government and the States play significant roles. The Federal\u00a0Government sets air quality standards for pollutants. The\u00a0States have the primary responsibility for determining how to\u00a0meet those standards and regulating sources within their\u00a0borders.&#8221;<\/p><\/blockquote>\n<p>The 2-1 ruling also notes that in past cases, the court has sided with the EPA &#8220;numerous&#8221; times, &#8220;when those\u00a0agency decisions met relevant statutory requirements and\u00a0complied with statutory constraints.&#8221; The two judges in favor of the ruling are both Republican appointees (one of them a <a href=\"http:\/\/www.nytimes.com\/1998\/09\/12\/us\/testing-president-authors-young-protege-starr-established-nonfiction-writer.html\">protege of Kenneth Star<\/a>). The dissenting judge is a Democratic appointee.<\/p>\n<p>Abbott&#8217;s office said a press release is forthcoming, but that no one there will be available to talk.
