Construction of the southern leg began last week.<\/p><\/div>\n<p>For the third time, The Texas Supreme Court has ruled against a pipeline company&#8217;s use of eminent domain.<\/p>\n<p>But the oil and gas industry did not give this one up without a fight.<\/p>\n<p>Here&#8217;s some background: In a <a href=\"http:\/\/www.star-telegram.com\/2011\/08\/30\/3324738\/ruling-on-denbury-resources-pipeline.html\">landmark ruling<\/a> at the Texas Supreme Court last August, a rice farmer in Beaumont (along with a rice farming consortium, Texas Rice Land Partners) won his case against the Denbury Green pipeline company, which had used eminent domain to route a carbon dioxide pipeline across his land. The 24-inch line stretches from Donaldsonville, Louisiana to the Hastings Field, outside of Houston, Texas. The farmer, Mike Latta, argued that the pipeline wasn&#8217;t in the public interest, as it was a private pipeline that would only be used by one company. The Supreme Court of Texas <a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/02\/13\/pipeline-companies-fight-for-right-to-take-property\/\">agreed<\/a>. (But the case took several years to make it to the Supreme Court, and in the meantime the company <a href=\"http:\/\/www.denbury.com\/Corporate-Responsibility\/Pipeline-Projects\/green-pipeline-project\/default.aspx\">built the pipeline anyways<\/a>.)<\/p>\n<p>Then the pipeline company &#8212; joined by the Texas Oil and Gas Association and several others associated with the industry (including\u00a0<a href=\"http:\/\/www.supreme.courts.state.tx.us\/ebriefs\/files\/20090901.htm\">notable names<\/a>\u00a0like the Koch Pipeline Company, Kinder Morgan and Occidental Chemical)\u00a0&#8212; \u00a0asked for an entire rehearing of the case, something of a rare move. In March, the\u00a0Supreme\u00a0Court said no, <a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/03\/02\/texas-supreme-court-reinforces-denbury-decision\/\">the decision stands<\/a>. Then the pipeline company Denbury Green\u00a0asked again for a rehearing.<\/p>\n<p>This week comes the latest answer: <a href=\"http:\/\/www.supreme.courts.state.tx.us\/historical\/2012\/aug\/090901c_rh.pdf\">No<\/a>. The company behind the pipeline used eminent domain against her (and over a hundred other Texas landowners) to route the pipeline through private land.<\/p>\n<p>To get eminent domain to route a pipeline across private land in Texas &#8212; a state that is <a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/07\/25\/why-changes-to-eminent-domain-in-texas-may-be-imminent\/\">95 percent private property<\/a>, and a bastion of landowner rights &#8212; all a company has to do is check a box on a two-page form to the Railroad Commission of Texas (which regulates drilling and pipelines in the state).<\/p>\n<div id=\"attachment_16868\"  class=\"wp-caption module image right\" style=\"max-width: 100px;\"><a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/08\/22\/texas-supreme-court-reinforces-denbury-decision-on-eminent-domain-again\/wainwright\/\" rel=\"attachment wp-att-16868\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-16868\" title=\"wainwright\" src=\"http:\/\/stateimpact.npr.org\/texas\/files\/2012\/08\/wainwright.jpg\" alt=\"\" width=\"100\" height=\"202\" \/><\/a><p class=\"wp-media-credit\">Photo courtesy of Texas Supreme Court<\/p><p class=\"wp-caption-text\">Justice Dale Wainwright wrote the latest opinion denying a rehearing of a landmark eminent domain case.<\/p><\/div>\n<p>By checking that box, the pipeline company says it is a &#8220;common carrier,&#8221; i.e. a pipeline that will be available at market rates for other companies to use, and therefore in the public interest.<\/p>\n<p>The Supreme Court reaffirmed this week that simply checking a box isn&#8217;t good enough. &#8220;The Court holds that, to be a \u201ccommon carrier\u201d carbon dioxide pipeline, and endowed by the\u00a0Natural Resources Code with the power to exercise eminent domain for public use, it must do more\u00a0than check a box on a government form,&#8221; <a href=\"http:\/\/www.supreme.courts.state.tx.us\/court\/justice_dwainwright.asp\">Justice Dale Wainwright<\/a>\u00a0(joined by <a href=\"http:\/\/www.supreme.courts.state.tx.us\/court\/justice_pjohnson.asp\">Justice Phil Johnson<\/a>) wrote in the latest concurring opinion in the case this week denying a second request for a rehearing.<\/p>\n<p>Many have <a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/07\/25\/why-changes-to-eminent-domain-in-texas-may-be-imminent\/\">called on the legislature to figure out eminent domain<\/a>\u00a0and common carrier status in Texas during the upcoming session.<\/p>\n<h5>Earlier: <a href=\"http:\/\/stateimpact.npr.org\/texas\/2012\/03\/06\/how-to-get-eminent-domain-in-texas-just-check-this-box\/\">How to Get Eminent Domain in Texas (Just Check This Box)<\/a><\/h5>\n","protected":false},"excerpt":{"rendered":"<p>For the third time, The Texas Supreme Court has ruled against a pipeline company&#8217;s use of eminent domain.
