Their goal? To protest a request from <a href=\"http:\/\/www.valero.com\/default.aspx\">Valero Energy Corp.<\/a> for tax breaks for some of its oil refineries through a system that could give millions of dollars back to one of Texas\u2019s most profitable corporations.<\/p>\n<p>So far this year Valero has earned more than $2 billion. That makes the possible millions Valero wants in tax exemptions kind of seem like small potatoes.<\/p>\n<p>But that, in turn, might be what has the 150 community activists and environmentalists chanting \u201cSay \u2018no\u2019 to Valero\u201d in front of TCEQ headquarters on Wednesday so angry.<!--more--><\/p>\n<p>They were protesting Valero\u2019s request for a property tax exemption for pollution-limiting equipment installed at its industrial sites.<\/p>\n<p>That would mean less money in the coffers of school districts in towns where Valero has refineries. Like the one in <a href=\"http:\/\/kut.org\/2011\/11\/valero-request-for-tax-break-draws-protest\/www1.pasadenaisd.org\/\">Pasadena, Texas,<\/a> a lot of those districts have already seen severe budget cuts.<\/p>\n<p>\u201cWe have shorter classes, we don\u2019t have extra classes like we used to,\u201d 13-year-old Destiny Gonzalez said. \u201cThe national academic league I wanted to compete in this year we no longer have, and we\u2019re literally scrambling out of the room because when the bell rings it\u2019s shorter than it was this year.\u201d<\/p>\n<p>Destiny spoke to TCEQ commissioners along with her mother, Pasadena PTO President Patricia Gonzalez, who said the protest wasn\u2019t just about Valero. She\u2019s worried about a domino effect.<\/p>\n<p>\u201cIf Valero gets it, we\u2019ve got many more oil companies that are waiting to see that happen,\u201d Gonzalez told KUT News. \u201cWe\u2019re already hurting as it is, but to take more away from us is so much more detrimental.\u201d<\/p>\n<p>The <a href=\"http:\/\/www.tceq.texas.gov\/airquality\/taxrelief\">tax break<\/a> was created to help environmentally friendly industries, but some of those protesting were environmentalists who originally backed the law\u2019s passage.<\/p>\n<p>\u201cProposition 2 was actually supported by environmental groups at the time, and it was to reward companies to install pollution control that really benefited communities,\u201d said Robin Schneider, executive director of the <a href=\"http:\/\/www.texasenvironment.org\/\">Texas Campaign for the Environment<\/a>.<\/p>\n<p>While Gonzalez opposes all tax breaks for refineries that would shortchange her school district, Schneider says tax breaks for Valero would be a misuse of a well-intentioned law. She points out that the equipment that Valero wants exemptions for is already required by the <a href=\"http:\/\/water.epa.gov\/polwaste\/\">Environmental Protection Agency<\/a>.<\/p>\n<p>\u201cEven the staff said it was against the rules,\u201d Schneider said. \u201cAnd this has happened to me before, where the rules say very clearly what\u2019s allowed and what\u2019s not allowed, but the bigwigs, the commissioners, just say, \u2018let\u2019s allow it in this case.\u2019\u201d<\/p>\n<p><div class=\"related-content alignleft\"><h4 class=\"related-header\">Related<\/h4><div class=\"links\"><h5>Posts<\/h5><ul><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/texas\/2011\/11\/01\/with-profits-like-these-does-valero-need-a-tax-break\/\">With Profits Like These, Does Valero Need a Tax\u00a0Break?<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/texas\/2011\/10\/31\/the-arguments-the-valero-tax-break\/\">The Arguments: The Valero Tax\u00a0Break<\/a><\/li><\/ul><\/div><div class=\"topics\"><h5>Topics<\/h5><p class=\"topic\"><img class=\"alignleft\" src=\"http:\/\/stateimpact.npr.org\/texas\/files\/2011\/08\/TCEQ1-60x60.jpg\" height=\"60\" width=\"60\" \/><a href=\"http:\/\/stateimpact.npr.org\/texas\/topic\/tceq\/\">What Is The Texas Commission of Environmental Quality?<\/a><\/p><\/div><\/div>Bill Day, a spokesman for Valero, doesn\u2019t see it that way.<\/p>\n<p>\u201cIt\u2019s true that we\u2019re required to have this equipment,\u201d Day said. \u201cWe\u2019re required by the EPA under their Tier 2 regulations, which call for basically the removal of sulfur from gasoline and diesel. Otherwise we never would have installed this equipment. It cost us tens of millions of dollars to put in.\u201d<\/p>\n<p>Day added the estimates that communities could lose tens of millions of dollars are exaggerated. And he said what Valero is trying to do is what you\u2019d expect any company to do: not leave money on the table.<\/p>\n<p>\u201cIt\u2019s pretty much the same as any other property owner getting a homestead exemption, or a senior citizens exemption or an ag exemption,\u201d Day said. \u201cThis is a process that\u2019s allowed under state law, and we\u2019re using the process that\u2019s called for.\u201d<\/p>\n<p>At the TCEQ protest, the comparison of a multibillion-dollar energy company to a senior citizen looking for a tax break likely would have been a pretty hard sell.<\/p>\n<p>And with corporate tax exemptions gaining more attention nationally, it\u2019s clear that many there, like liberal activist and former Texas Agriculture Commissioner Jim Hightower, are hoping to tie Valero\u2019s request to larger political trends.<\/p>\n<p>\u201cThis is the kind of collusion between corporate elites and government officials that have caused a rebellion in this country in Wisconsin and now in the Occupy movement in some 600 communities across America,\u201d Hightower said. \u201cPeople are fed up.\u201d<\/p>\n<p>Whether that kind of message will resonate with TCEQ Commissioners is another question entirely. At the hearing Wednesday they couldn\u2019t comment on the Valero exemption because it wasn\u2019t on their agenda.
