House Democrats File Brief In Impact Fee Suit
The House Democratic Caucus has filed an Amici Curiae — that’s “friends of the court” for everyone who didn’t take freshman Latin — brief in the lawsuit a handful of townships have filed against Pennsylvania’s new Act 13.
The brief mirrors the lawsuit’s argument: that the legislation’s restriction on local zoning and regulation of drilling is unconstitutional.
Commonwealth Court has issued an injunction delaying those restrictions from going into effect, though the judge did write a footnote stating he was “not convinced that petitioners’ likelihood of success on the merits is high.”
