Pat Ownbey, R-Ardmore, has until Tuesday to ask the house to reconsider the measure, which failed on a 41-43 vote.<\/p><p>All retail sales \u2014 online and otherwise \u2014are taxable in Oklahoma. But the Internet tax debate comes down to responsibility for collection.<\/p><p><!--more--><\/p><p>For a standard brick-and-mortar store, it\u2019s straightforward: The retailer collects the sales tax. The same goes for online retailers that have a physical presence \u2014 like a storefront or warehouse \u2014 in Oklahoma.<\/p><p>If the online retailer doesn\u2019t have a physical presence in Oklahoma, the sale is subject to the state use tax, which is set at the same rate as the sales tax, but is self-assessed and collected by the buyer.<\/p><p>Retailers are good at collecting sales taxes; Oklahomans aren\u2019t so great about taxing themselves. <a href=\"http:\/\/stateimpact.npr.org\/oklahoma\/2011\/12\/14\/most-oklahoma-tax-filers-don%E2%80%99t-pay-unenforceable-use-tax\/\">Less than 4 percent<\/a> of Oklahoma tax-filers actually pay the use tax, tax commission records show.<\/p><p>[bill id=&#8221;HB 2586&#8243; state=ok session=&#8221;2011-2012&#8243; align=left]<\/p><p>The only real way to capture the ever-growing revenue stream of online sales is to make the retailer responsible for collection.<\/p><p>The <em>Tulsa World<\/em> <a href=\"http:\/\/www.tulsaworld.com\/news\/article.aspx?subjectid=336&articleid=20120312_16_A1_OLHMIY650640&rss_lnk=12\">explains<\/a>:<\/p>\n<blockquote><p>House Bill 2586 would change the definition of a retail presence to include companies that have people who deliver, install, assemble or perform maintenance services for the retailer. It also would include companies that use the same trademarks, service marks, or trade names in Oklahoma as they use online under a different corporate name.<\/p><\/blockquote><p>Another issue is brick-and-mortar stores, who\u2019ve lobbied hard \u2014 both at the state and <a href=\"http:\/\/stateimpact.npr.org\/oklahoma\/2011\/11\/17\/okc-retailers-in-d-c-to-push-internet-sales-tax-bill\/\">national level<\/a> \u2014 and complain that their non tax-collecting online counterparts have an unfair advantage.<\/p><p>Some state lawmakers argue that HB 2586 is too broad, including Rep.
