{"id":35298,"date":"2022-10-20T17:25:00","date_gmt":"2022-10-20T22:25:00","guid":{"rendered":"https:\/\/stateimpact.npr.org\/oklahoma\/?p=35298"},"modified":"2022-10-20T17:26:47","modified_gmt":"2022-10-20T22:26:47","slug":"metadata-show-oklahoma-turnpike-authority-modified-public-meeting-agendas","status":"publish","type":"post","link":"https:\/\/stateimpact.npr.org\/oklahoma\/2022\/10\/20\/metadata-show-oklahoma-turnpike-authority-modified-public-meeting-agendas\/","title":{"rendered":"Metadata show Oklahoma Turnpike Authority modified public meeting agendas"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Metadata from publicly posted meeting agendas appear to indicate Oklahoma turnpike staff altered agendas for a pair of public meetings leading up to the <\/span><a href=\"https:\/\/oklahoma.gov\/content\/dam\/ok\/en\/ota\/documents\/news-articles\/2022\/Officials%20unveil%20first%20look%20at%20ACCESS.pdf\"><span style=\"font-weight: 400;\">announcement<\/span><\/a><span style=\"font-weight: 400;\"> of a <\/span><a href=\"https:\/\/www.accessoklahoma.com\/\"><span style=\"font-weight: 400;\">controversial $5 billion turnpike project<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">The Norman Transcript <\/span><a href=\"https:\/\/www.normantranscript.com\/news\/which-version-documents-ota-modified-meeting-agendas-in-january-february\/article_eb6612fc-4f33-11ed-8146-c32992a95f6f.html\"><span style=\"font-weight: 400;\">first reported<\/span><\/a><span style=\"font-weight: 400;\"> the news.<\/span><\/p><p><span style=\"font-weight: 400;\">Attorney Richard Labarthe produced documents showing <\/span><a href=\"https:\/\/bloximages.chicago2.vip.townnews.com\/normantranscript.com\/content\/tncms\/assets\/v3\/editorial\/8\/9e\/89e30196-4f35-11ed-9306-d7fea44c5358\/634f2b52c4f24.pdf.pdf\"><span style=\"font-weight: 400;\">metadata taken from the agendas<\/span><\/a><span style=\"font-weight: 400;\">. According to the data from the OTA\u2019s Jan. 25 and Feb. 22 meetings, the agendas were modified after the meeting took place. StateImpact Oklahoma independently verified this data.<\/span><\/p><p><span style=\"font-weight: 400;\">For the Jan. 25 meeting, data show the agenda document was created on Jan. 18 and last modified around 10 p.m. on Feb. 13.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">For the Feb. 22 meeting, data show the agenda document was created on Feb. 17 and last modified just after 3 p.m. the next day, Feb. 23.<\/span><\/p><p><span style=\"font-weight: 400;\">Similar after-meeting revisions aren\u2019t found on any other meeting agendas posted by the agency for the last two years.<\/span><\/p><p><span style=\"font-weight: 400;\">The OTA announced its ACCESS turnpike project on Feb. 22. Since then, the project has drawn <\/span><a href=\"https:\/\/www.pikeoffota.com\/\"><span style=\"font-weight: 400;\">widespread pushback<\/span><\/a><span style=\"font-weight: 400;\">, including legislative organizing and judicial challenges.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Labarthe and a team of attorneys are representing dozens of plaintiffs affected by the turnpike project in a <\/span><a href=\"https:\/\/www.oscn.net\/dockets\/GetCaseInformation.aspx?db=cleveland&number=CV-2022-1905&cmid=2406514\"><span style=\"font-weight: 400;\">lawsuit filed in May<\/span><\/a><span style=\"font-weight: 400;\">. The suit alleges the agency violated the Oklahoma Open Meeting Act by failing to sufficiently inform the public of the ACCESS project with the available agenda documents (available here: <\/span><a href=\"https:\/\/pikepass.com\/pdf\/25January2022_Agenda.pdf\"><span style=\"font-weight: 400;\">January<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/pikepass.com\/pdf\/February%2022%202022%20Agenda.pdf\"><span style=\"font-weight: 400;\">February<\/span><\/a><span style=\"font-weight: 400;\">).\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">The metadata don\u2019t include a version history showing the original agendas in their pre-modified forms. StateImpact Oklahoma filed an Open Records Request with the OTA Wednesday for these original documents. Labarthe said his team plans to ask Judge Tim Olsen at a hearing next week to allow forensic experts to look at the OTA\u2019s hard drive.<\/span><\/p><p><span style=\"font-weight: 400;\">The data also list the document authors: Todd Gore, the OTA\u2019s director of right-of-way and utilities, authored the January agenda; and Jenny Johnson, the administrative assistant to OTA Executive Director Tim Gatz, authored the February agenda.<\/span><\/p><p><span style=\"font-weight: 400;\">On Oct. 18, the plaintiffs\u2019 counsel filed a motion to allow the deposition of Johnson. Later that day, the agendas\u2019 metadata was discovered, and a <\/span><a href=\"https:\/\/bloximages.chicago2.vip.townnews.com\/normantranscript.com\/content\/tncms\/assets\/v3\/editorial\/8\/9e\/89e30196-4f35-11ed-9306-d7fea44c5358\/634f2b52c4f24.pdf.pdf\"><span style=\"font-weight: 400;\">supplemental document<\/span><\/a><span style=\"font-weight: 400;\"> was filed asking the court to order the OTA to produce Johnson and Gore for depositions, as well as for the original agendas.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cThe OTA has relied on these agenda items to buttress its contention that it has complied with the [Oklahoma Open Meeting Act]. (&#8230;) [In] the case of both the January and February agenda, the metadata shows that the agendas were modified and re-uploaded to the OTA website <\/span><b>after<\/b><span style=\"font-weight: 400;\"> the meetings took place,\u201d the document reads. \u201cCompliance with the [Oklahoma Open Meeting Act] by posting the agendas is at the heart of the Plaintiffs\u2019 case.\u201d<\/span><\/p><p><b>When it comes to ACCESS, what\u2019s on the agendas, and what happened during the meetings?<\/b><\/p><p><span style=\"font-weight: 400;\">On the January meeting agenda, there is no mention by name of the ACCESS project, but rather \u201cSP [Special Project]-65,\u201d which is penned later in an addendum as \u201cLong Range Turnpike Improvement and Expansion Program.\u201d\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">The agenda item is to approve a program management contract not to exceed $4.96 million for the engineering firm Poe and Associates. The February meeting minutes show all engineering contracts were approved unanimously.<\/span><\/p><p><b>Response from the OTA<\/b><\/p><p><span style=\"font-weight: 400;\">An OTA spokesperson denied the allegations in a statement Wednesday.<\/span><\/p><p><span style=\"font-weight: 400;\">\u201cAllegations of wrong doing by altering or modifying agendas following two OTA Board meetings based on a search of metadata are both ill-informed and inflammatory,\u201d the spokesperson wrote. \u201cThe only modification to the documents posted to the OTA website was the addition of signatures, certifying the meetings occurred.\u201d<\/span><\/p><p><span style=\"font-weight: 400;\">In response, the spokesperson was asked why out of the last two years, only two months\u2019 agendas show modifications after the meetings had taken place, and why it would take nearly four weeks to add certification signatures for the January meeting when it only took a day to modify the February meeting.
