On Friday he took the first step toward <a title=\"StateImpactLink\" href=\"https:\/\/stateimpact.npr.org\/oklahoma\/2015\/10\/26\/oklahoma-attorney-general-prepares-lawsuit-to-fight-clean-power-plan\/\" target=\"_blank\">suing EPA over the Clean Power Plan<\/a>, and now he&#8217;s doing the same for the recently published new ozone limits.<!--more--><\/p><p>From\u00a0<em>The Oklahoman<\/em>&#8216;s <a title=\"NewsOKlink\" href=\"http:\/\/newsok.com\/oklahoma-joins-five-states-in-suit-against-new-epa-ozone-limits\/article\/5456440?custom_click=rss\" target=\"_blank\">Paul Monies:<\/a><\/p>\n<blockquote><p>Attorney General Scott Pruitt&#8217;s office said Tuesday that Oklahoma joined Arizona, Arkansas, New Mexico&#8217;s Environmental Department and North Dakota in a petition for review filed with the U.S. Court of Appeals for the District of Columbia Circuit.<\/p><p>The rules were published Monday in the Federal Register. They establish a limit of 70 parts per billion for ozone, which is formed at the ground level when the sun heats nitrogen oxides and volatile organic compounds. Automobiles, power plants and industrial facilities account for most of those emissions.<\/p><p>The current limit for ozone is 75 parts per billion, put in place in 2008.<\/p><\/blockquote><p>As <a title=\"StateImpactLink\" href=\"https:\/\/stateimpact.npr.org\/oklahoma\/2015\/10\/15\/oklahoma-air-quality-improves-as-feds-roll-out-new-ozone-limits\/\" target=\"_blank\">StateImpact&#8217;s Joe Wertz reported after the rule was finalized<\/a> in early October, the new ozone limit shouldn&#8217;t be a major burden for Oklahoma:<\/p>\n<blockquote><p>With the new 70 parts per billion ground-level ozone standard \u2014 which is determined through\u00a0<a href=\"http:\/\/www3.epa.gov\/region1\/airquality\/avg8hr.html\">a calculation<\/a>\u00a0of a specific monitoring site\u2019s three-year average \u2014 most counties in Oklahoma should be in compliance, says the DEQ\u2019s Goeller.<\/p><p>\u201cWe\u2019ll have a couple sites that will be right on the borderline if things keep going the way they\u2019ve gone the last couple of years,\u201d he says.<\/p><\/blockquote><p>Many saw the 70 parts per billion limit as a win for industry groups, since it&#8217;s not a strict as the 65 parts per billion environmental groups were hoping for.
