Mary Fallin at the 2013 State of the State address at the state capitol.<\/p>\n<\/div><p>When <a title=\"StateImpactLInk\" href=\"http:\/\/stateimpact.npr.org\/oklahoma\/2014\/06\/02\/oklahoma-attorney-general-ready-to-fight-epa-proposal-to-cut-carbon-emissions\/\" target=\"_blank\">StateImpact reported<\/a> on President Barack Obama&#8217;s proposal to cut carbon emissions 30 percent nationally by 2030, mainly through less reliance on coal-fired power plants, Oklahoma Attorney General <a title=\"StateImpactLink\" href=\"http:\/\/stateimpact.npr.org\/oklahoma\/2014\/06\/02\/oklahoma-attorney-general-ready-to-fight-epa-proposal-to-cut-carbon-emissions\/\" target=\"_blank\">Scott Pruitt&#8217;s reaction<\/a> made it clear a lawsuit was coming.<\/p><p>On Tuesday, it became official. Oklahoma joined West Virginia \u2014 which is leading the case \u2014 and 10 other states to <a title=\"OK.govlink\" href=\"http:\/\/www.ok.gov\/oag\/documents\/Section%20111d%20Settlement%20Filing.pdf\" target=\"_blank\">sue the U.S. Environmental Protection Agency<\/a>.<\/p><p>From\u00a0<em>The Oklahoman<\/em>&#8216;s <a title=\"NewsOKlink\" href=\"http:\/\/newsok.com\/oklahoma-attorney-general-11-others-sue-epa-over-proposed-carbon-rules\/article\/5127086\" target=\"_blank\">Paul Monies<\/a>:<\/p>\n<blockquote><p>The attorneys general \u201411 Republicans and one Democrat \u2014 contend the agency doesn&#8217;t have the legal authority to issue the proposed rules under Section 11(d) of the Clean Air Act. They said the proposed rules are in conflict with a 2011 settlement the EPA signed with some other states after a lawsuit brought by several environmental groups.<\/p><p>Pruitt said the 2011 settlement said the EPA would use another section of the Clean Air Act to regulate emissions from power plants and stationary sources.<\/p><\/blockquote><p><!--more-->The settlement led to the <a title=\"EPAlink\" href=\"http:\/\/www2.epa.gov\/carbon-pollution-standards\" target=\"_blank\">rules Obama announced<\/a> in early June. <a title=\"OklahomaAGlink\" href=\"http:\/\/www.ok.gov\/triton\/modules\/newsroom\/newsroom_article.php?id=258&article_id=14535\" target=\"_blank\">In a press release<\/a>, Pruitt says &#8220;the EPA made a promise in 2011 to expand its authority to regulate greenhouse gas emissions from existing power plants&#8221; and the Clean Air Act doesn&#8217;t allow the agency to do that.<\/p><p>But EPA spokeswoman Jennifer Colaizzi told\u00a0<em>The Oklahoman<\/em> the agency has a good track record when it comes to staying within the laws as passed by Congress:<\/p>\n<blockquote><p>&#8220;History has shown that EPA writes solid rules and they stand up in court \u2014 the courts have reaffirmed our science and reasoning time and time again,&#8221; Colaizzi said in an email. &#8220;The Supreme Court made clear in 2007, and just recently confirmed, EPA has an obligation to limit carbon pollution because it&#8217;s a harm to human health.&#8221;<\/p><\/blockquote><p><a title=\"StateImpactLink\" href=\"http:\/\/stateimpact.npr.org\/oklahoma\/2014\/06\/12\/court-losses-wont-deter-attorney-general-scott-pruitt-in-his-fight-with-the-epa\/\" target=\"_blank\">Pruitt hasn&#8217;t had the best of luck<\/a> going up against the EPA, with unsuccessful bids to stop the cross-state air pollution rule, mercury and air toxics protections, and regional haze rule.
