C.L. &#8220;Butch&#8221; Otter got a reprieve, if he wants it.\u00a0 Friday, Nov. 16 was supposed to be the final day for states to tell the federal government whether they will set up their own <a href=\"http:\/\/healthreform.kff.org\/faq\/what-is-a-health-insurance-exchange.aspx\" target=\"_blank\">health insurance exchanges<\/a>.<\/p>\n<p>It was a deadline established by the U.S. Department of Health and Human Services, to ensure the exchanges are online<del><\/del> by 2014.\u00a0 But Republican governors asked for more time, and <a href=\"http:\/\/www.washingtonpost.com\/national\/health-science\/states-get-more-time-to-decide-whether-to-build-health-exchanges\/2012\/11\/15\/0599a866-2f76-11e2-9f50-0308e1e75445_story.html\" target=\"_blank\">yesterday they got it<\/a>.<\/p>\n<p>The Idaho Legislature does not convene again until early next year, so this decision still falls to the governor.\u00a0 And if Gov. Otter follows the <a title=\"Idaho\u2019s Health Insurance Exchange Group Makes Recommendation; Decision Now Rests With Gov. Otter<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/idaho\/idaho-racks-up-15000-bill-on-health-insurance-exchange-work-group-so-far\/\">Idaho Racks Up $15,000 Bill On Health Insurance Exchange Work Group, So Far<\/a><\/li><\/ul><\/div><div class=\"topics\"><h5>Topics<\/h5><p class=\"topic\"><img class=\"alignleft\" src=\"http:\/\/stateimpact.npr.org\/idaho\/files\/2012\/06\/Capitol-Wide-Shot-ERS.jpg\" height=\"60\" width=\"60\" \/><a href=\"http:\/\/stateimpact.npr.org\/idaho\/topic\/health-insurance-exchange\/\">Idaho&#8217;s Health Insurance Exchange Debate<\/a><\/p><\/div><\/div>\n<p>&#8220;Last I heard, he couldn&#8217;t just do an executive order and put it in place,&#8221; House Majority Leader Mike Moyle (R-Star) said last week, referring to the governor&#8217;s authority to settle on a state-based exchange.\u00a0 Along with House Speaker Lawerence Denney (R-Midvale), Moyle has pushed for the state to &#8220;<a href=\"http:\/\/magicvalley.com\/blogs\/capitol-confidential\/denney-moyle-encourage-idaho-to-not-implement-affordable-care-act\/article_6aaa3422-cb9a-11e1-a311-001a4bcf887a.html\" target=\"_blank\">resist Obamacare<\/a>,&#8221; and refuse to implement the Affordable Care Act.<\/p>\n<p>Gov. Otter&#8217;s press secretary, Jon Hanian, declined to comment directly on Rep. Moyle&#8217;s view.\u00a0 Several calls to the governor&#8217;s chief of staff, David Hensley, went unanswered.\u00a0 The governor&#8217;s legal counsel, Tom Perry, also has not returned calls.<\/p>\n<p>Former Idaho Attorney General David Leroy did agree to shed some light.\u00a0 &#8220;The governor can certainly create an initiative, begin to put into place rudiments.\u00a0 But eventually, because we\u2019re going to be talking long-term, we will probably require statutes,&#8221; Leroy says.<\/p>\n<p>He explains an exchange will also require money, which the Legislature must approve.\u00a0 &#8220;Over the term that this enterprise takes to create, and over its functional life, certainly it will require the joint action of legislature and executive,&#8221; he says.<\/p>\n<p>Sen. Dean Cameron (R-Rupert) &#8212; who owns an insurance company, co-chairs<del><\/del> the <a title=\"Your Guide to JFAC (Joint Finance Appropriations Committee)\" href=\"http:\/\/stateimpact.npr.org\/idaho\/topic\/jfac\/\">Joint Finance-Appropriations Committee<\/a> and the Legislative Health Care Task Force, and advocates a state-based exchange &#8212; agrees.\u00a0 &#8220;At some point the Legislature will have to act,&#8221; he says.<\/p>\n<p>And, if the governor does indeed support a state-based exchange, will the lawmakers who have resisted that decision come along?\u00a0 Cameron believes so, though it may not happen easily.<\/p>\n<p>&#8220;I can\u2019t tell you how big of a battle that will be,&#8221; he says. &#8220;There certainly are those who are opposed. There will be some who will vote no to vote no.&#8221;<\/p>\n<p>Still, Cameron doesn&#8217;t think that position will win out.<\/p>\n<p>&#8220;The majority of the Legislature, I think, will be reasonable about it,&#8221; he says.\u00a0 &#8220;And if that\u2019s the way the governor decides to go, I think they will support it.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gov.
