The paddles allegedly left welts on Gierrea\u2019s bottom and Jones has filed a notice to sue the Levy County School District.<\/p><\/div>\n<p>State law allows schools in Florida <a href=\"http:\/\/stateimpact.npr.org\/florida\/2012\/03\/12\/why-florida-schools-want-the-right-to-paddle-misbehaving-students\/\">to punish students by spanking them with a paddle<\/a>, which is often a wooden or plexiglass board.<\/p>\n<p>The administrators at most schools with corporal punishment policies ask parents for permission to paddle their children. Many principals say they will not paddle a kid against the parent\u2019s wishes.<\/p>\n<p>But schools don\u2019t always check the paperwork before they administer the punishment.<\/p>\n<p>And when that happens, Florida statutes protect the principals and teachers from lawsuits.<\/p>\n<p><strong>Florida<\/strong><strong> Law Protects Principals and Teachers<\/strong><\/p>\n<p>Robert Rush, a civil rights attorney in Gainesville, says\u00a0state law does not require schools to get parental consent.<\/p>\n<p>&#8220;If the school board and the principal specifically authorize corporal punishment, it can be administered lawfully against the parent&#8217;s wishes,&#8221; Rush said.\u00a0<!--[if lt IE 9]><script>document.createElement('audio');<\/script><![endif]-->\n<audio class=\"wp-audio-shortcode\" id=\"audio-5551-1\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/Spanking-Lawsuit-w-intro.mp3?_=1\" \/><a href=\"https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/Spanking-Lawsuit-w-intro.mp3\">https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/Spanking-Lawsuit-w-intro.mp3<\/a><\/audio><\/p>\n<p><!--more--><\/p>\n<p>State statutes say a principal or the principals designated representative \u201c<a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?mode=View%20Statutes&amp;SubMenu=1&amp;App_mode=Display_Statute&amp;Search_String=768.28&amp;URL=0700-0799\/0768\/Sections\/0768.28.html\">shall not be civilly or criminally liable for any action carried out in conformity<\/a> with the State Board of Education and district school board rules regarding the control, discipline, suspension, and expulsion of students.\u201d<\/p>\n<p>(Check out our map of districts which practice corporal punishment <a href=\"http:\/\/stateimpact.npr.org\/florida\/maps\/corporal-punishment-in-florida-schools\/\">here<\/a>.)<\/p>\n<p>That means schools cannot be sued for paddling students.<\/p>\n<p>&#8220;And part of the reason for that is to do a balancing test so that we&#8217;re not disrupting schools unnecessarily with frivolous claims,&#8221; Rush said.<\/p>\n<p><a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?mode=View%20Statutes&amp;SubMenu=1&amp;App_mode=Display_Statute&amp;Search_String=1006.11&amp;URL=1000-1099\/1006\/Sections\/1006.11.html\">The only way a parent can sue<\/a> is to argue excessive force or cruel and unusual punishment.<\/p>\n<p>In Levy County, Tenika Jones is making that claim.<\/p>\n<div id=\"attachment_5560\"  class=\"wp-caption module image left\" style=\"max-width: 300px;\"><a class=\"fancybox\" title=\"A typical wooden paddle used for school corporal punishment. \" href=\"http:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-1-paddle-11.jpg\" rel=\"\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-5560\" title=\"CP 1 - paddle 1\" src=\"http:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-1-paddle-11-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-1-paddle-11-300x225.jpg 300w, https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-1-paddle-11-620x465.jpg 620w, https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-1-paddle-11-220x165.jpg 220w, https:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-1-paddle-11-138x103.jpg 138w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p class=\"wp-media-credit\">Sarah Gonzalez \/ StateImpact Florida<\/p><p class=\"wp-caption-text\">A typical wooden paddle used for school corporal punishment.<\/p><\/div>\n<p><strong><\/strong><strong>Mom Says Paddling Left Welts on Preschooler<\/strong><\/p>\n<p><strong><\/strong>Her son Gierrea Bostick was paddled during his second week of preschool at Joyce Bullock Elementary in Williston, Fla.<\/p>\n<p>Gierrea slapped another boy on the school bus. He was five years old.<\/p>\n<p>Gierrea says he was taken off the bus and sent to the principal&#8217;s office for a spanking.<\/p>\n<p>&#8220;She spank me on my booty,\u201d Gierrea said.\u00a0\u201cI cried all the way home. It was really hard.&#8221;<\/p>\n<p>Jones says the wooden paddle left welts on Gierrea&#8217;s bottom.<\/p>\n<p>And she says her son&#8217;s welts show that excessive force was used.<\/p>\n<p>&#8220;If I would have hit my son how she hit him, I would have been in jail, I would have been on the news, I would have been messed up trying to get my children back, how she hit my son,\u201d Jones said. \u201cShe whipped him up and to me that&#8217;s child abuse.&#8221;<\/p>\n<p>Jones did not sign the waiver the school sent home asking for permission to paddle her son.<\/p>\n<p>She has filed a notice to sue the Levy County School District.<\/p>\n<div class=\"related-content alignright\"><h4 class=\"related-header\">Related<\/h4><div class=\"links\"><h5>Posts<\/h5><ul><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/2012\/03\/14\/why-school-leaders-say-theres-nothing-sexual-about-paddling\/\">Why School Leaders Say There\u2019s Nothing Sexual About Paddling Students<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/maps\/corporal-punishment-in-florida-schools\/\">Mapping Corporal Punishment in Florida Schools<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/2012\/03\/12\/why-florida-schools-want-the-right-to-paddle-misbehaving-students\/#more-5441\">Why Florida Schools Want the Right to Paddle Misbehaving Students<\/a><\/li><\/ul><\/div><div class=\"topics\"><h5>Topics<\/h5><p class=\"topic\"><img class=\"alignleft\" src=\"http:\/\/stateimpact.npr.org\/florida\/files\/2012\/03\/CP-04-Eddie-Dixson-60x60.jpg\" height=\"60\" width=\"60\" \/><a href=\"http:\/\/stateimpact.npr.org\/florida\/topic\/school-corporal-punishment\/\">What Does the Law Say About School Corporal Punishment?<\/a><\/p><\/div><\/div>\n<p>The school&#8217;s principal, Jamie Handlin, and the school district would not comment because they&#8217;re in pre-litigation.<\/p>\n<p>But the principal <a href=\"http:\/\/www.willistonpioneer.com\/content\/mother-outraged-son-spanked-school\">has said in the past that the waiver is only a courtesy<\/a>.<\/p>\n<p>Attorney Rush agrees.<\/p>\n<p>And he says Gierrea&#8217;s mom faces an uphill battle.<\/p>\n<p>In a letter to Gierrea&#8217;s family, the attorney for the Levy County school district cited criminal child abuse cases that ruled welts and bruises on a child&#8217;s bottom are not evidence of excessive force.<\/p>\n<p>Still the attorney offered the family $1,000 to settle the case.<\/p>\n<p>Gierrea&#8217;s mom rejected the offer.<\/p>\n<p>She says there needs to be a consequence for the principal&#8217;s actions.<\/p>\n<p>&#8220;She should be fired,\u201d Jones said. &#8220;Put her on suspension or something.\u201d<\/p>\n<p>But attorneys say the most the mom will get is money, or maybe get the school district to change its policy.<\/p>\n<p>It\u2019s been a year since Gierrea was paddled at Joyce Bullock Elementary.\u00a0And Tenika Jones has demanded no more interaction between the principal and her son.<\/p>\n<p>\u201cThis lady is still at this school and ain&#8217;t nothing happened,&#8221; Jones said. &#8220;So I told her, I say &#8216;ma\u2019am, I don&#8217;t want you talking to my child.'&#8221;<\/p>\n<p>Jones is forced to keep Gierrea enrolled at Joyce Bullock.<\/p>\n<p>It&#8217;s the only public school in their small town for kindergarten through second grade.<\/p>\n<p>Gierrea will have to stay there for two more years.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>State law allows schools in Florida to punish students by spanking them with a paddle, which is often a wooden or plexiglass board.
