Congress hasn\u2019t been able to do it, so I will,&#8221; the President said.<\/p>\n<p>It&#8217;s a line President Obama could easily use in <a href=\"http:\/\/www.washingtontimes.com\/news\/2012\/jan\/8\/pelosi-obama-should-run-against-do-nothing-congres\/\" target=\"_blank\">a re-election campaign<\/a> should he choose to run based on what lawmakers didn&#8217;t do during his tenure.<\/p>\n<p>If he does go down that path, the administration&#8217;s waiver plan \u2014 in the face of Congress&#8217; <a href=\"http:\/\/educationnext.org\/harkin-enzis-hodgepodge\/\" target=\"_blank\">stalled re-writes<\/a> of the <a href=\"http:\/\/stateimpact.npr.org\/indiana\/2011\/08\/29\/why-more-schools-are-meeting-indianas-performance-targets-while-fewer-meet-federal-standards\/\" target=\"_blank\">unpopular<\/a> No Child Left Behind law \u2014 would be a logical talking point for the President&#8217;s <a href=\"http:\/\/abcnews.go.com\/Politics\/OTUS\/obama-state-union-congress-campaign-hits-capitol-hill\/story?id=15424001#.Tx6-Z-PLxM4\" target=\"_blank\">election-year State of the Union address<\/a> Tuesday night.<\/p>\n<p><!--more--><\/p>\n<div class=\"related-content alignright\"><h4 class=\"related-header\">Related<\/h4><div class=\"links\"><h5>Posts<\/h5><ul><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/2011\/11\/18\/three-florida-colleges-leave-graduates-deep-in-debt\/\">Three Florida Colleges Leave Graduates Deep in\u00a0Debt<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/2011\/09\/23\/what-new-no-child-left-behind-rules-mean-for-you\/\">What New \u2018No Child Left Behind\u2019 Rules Mean For\u00a0You<\/a><\/li><li class=\"link\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/2012\/01\/23\/everything-you-need-to-know-about-education-and-the-florida-2012-gop-primary\/\">Everything You Need to Know About Education and the Florida 2012 GOP Primary<\/a><\/li><\/ul><\/div><div class=\"topics\"><h5>Topics<\/h5><p class=\"topic\"><img class=\"alignleft\" src=\"http:\/\/stateimpact.npr.org\/florida\/files\/2011\/08\/arne-duncan-60x60.jpg\" height=\"60\" width=\"60\" \/><a href=\"http:\/\/stateimpact.npr.org\/florida\/topic\/arne-duncan\/\">Meet Your U.S. Secretary Of Education Arne Duncan<\/a><\/p><\/div><\/div>\n<p>To be fair, <a href=\"http:\/\/www.edtrust.org\/sites\/edtrust.org\/files\/ESEA_Letter_0.pdf\">left-leaning groups<\/a> may share <a href=\"http:\/\/www.edweek.org\/ew\/articles\/2011\/11\/11\/12esea_ep.h31.html?tkn=YUWFr8kW0QdsOyRfzV48dlaJPbRwlNZqt%2Bqn&amp;cmp=clp-edweek\" target=\"_blank\">some of the blame<\/a> for Congress&#8217; <a href=\"http:\/\/www.edweek.org\/ew\/articles\/2011\/11\/11\/12esea_ep.h31.html?tkn=YUWFr8kW0QdsOyRfzV48dlaJPbRwlNZqt%2Bqn&amp;cmp=clp-edweek\" target=\"_blank\">alleged foot-dragging<\/a> with the right-leaning lawmakers leading the House.<\/p>\n<p>But while polls suggest an overhaul of NCLB <a href=\"http:\/\/www.gallup.com\/poll\/145952\/americans-lean-toward-revising-no-child-left-behind.aspx\" target=\"_blank\">is overwhelmingly popular<\/a>, the <a href=\"http:\/\/newamerica.net\/user\/46\" target=\"_blank\">New America Foundation&#8217;s Jennifer Cohen<\/a> says &#8216;No Child&#8217; is one more issue over which President Obama can lament partisan gridlock on Capitol Hill.<\/p>\n<p>&#8220;We&#8217;ve basically found out we&#8217;re at a time in politics when education is no longer a bipartisan issue,&#8221; says Cohen, an education policy analyst. She says education issues should &#8220;figure prominently&#8221; in the President&#8217;s address.<\/p>\n<h3>An NCLB Waiver Refresher<\/h3>\n<p>With the number of <a href=\"http:\/\/www.cep-dc.org\/displayDocument.cfm?DocumentID=386\" target=\"_blank\">U.S. schools failing to meet lofty progress goals<\/a> outlined under NCLB believed to be on the rise, the Obama administration says \u2014 as most now do \u2014 the 2001 law is outdated. Two <a title=\"Will The No Child Left Behind Rewrite Go Somewhere This Time?\" href=\"http:\/\/stateimpact.npr.org\/indiana\/2011\/10\/24\/will-the-no-child-left-behind-rewrite-go-somewhere-this-time\/\" target=\"_blank\">efforts to fix the law<\/a> in Congress this year have fizzled.<\/p>\n<p>In response, Secretary of Education Arne Duncan announced federal officials would offer the waivers as a remedy to state education departments. Duncan says if state officials can come up with a better way to narrow the socio-economic achievement gap while still holding schools accountable for their progress and performance, the feds won&#8217;t hold the state to NCLB&#8217;s <a title=\"\u2018AYP Cap\u2019 Lowered State Letter Grades Of 300+ Indiana Schools\" href=\"http:\/\/stateimpact.npr.org\/indiana\/2011\/10\/07\/ayp-cap-lowered-state-letter-grades-of-300-indiana-schools\/\">&#8220;Adequate Yearly Progress&#8221; benchmarks<\/a> (which <a href=\"http:\/\/titleonederland.blogs.thompson.com\/2012\/01\/17\/typin%E2%80%99-and-cryin%E2%80%99-goodbye-nclb-ayp\/?utm_source=rss&amp;utm_medium=rss&amp;utm_campaign=typin%25e2%2580%2599-and-cryin%25e2%2580%2599-goodbye-nclb-ayp\" target=\"_blank\">isn&#8217;t all good<\/a>, writes <em>Title I-derland<\/em>).<\/p>\n<p>&#8220;The tradeoff is raise a high bar, hold folks accountable for results, but give them a lot more autonomy, and be a lot less prescriptive, a lot less top-down,&#8221; Duncan <a href=\"http:\/\/stateimpact.npr.org\/ohio\/2011\/09\/08\/q-a-arne-duncan-answers-your-questions-from-his-tour-bus\/\" target=\"_blank\">told <em>StateImpact Ohio<\/em> in September<\/a>.<\/p>\n<p>Eleven states have already <a href=\"http:\/\/stateimpact.npr.org\/florida\/2011\/11\/15\/florida-asks-for-exemption-on-nclb-mandates\/\" target=\"_blank\">applied<\/a> for waivers \u2014 Colorado, <a href=\"http:\/\/stateimpact.npr.org\/florida\/2011\/11\/15\/florida-asks-for-exemption-on-nclb-mandates\/\" target=\"_blank\">Florida<\/a>, Georgia, <a href=\"http:\/\/stateimpact.npr.org\/indiana\/2011\/11\/18\/state-expects-all-indiana-schools-to-earn-as-by-2020\/#annotation\/a38836\" target=\"_blank\">Indiana<\/a>, Kentucky, Massachusetts, Minnesota, New Jersey, New Mexico, Oklahoma and Tennessee. Officials in other states, such as Ohio, have said <a href=\"http:\/\/stateimpact.npr.org\/ohio\/2012\/01\/11\/ohio-will-apply-for-waiver-from-no-child-left-behind-acts-requirements-by-feb-18\/\" target=\"_blank\">they will submit their own applications<\/a> by mid-February.<\/p>\n<p>The waivers are already intertwined with some states&#8217; education policies. Indiana&#8217;s NCLB waiver, for example, <a href=\"http:\/\/stateimpact.npr.org\/indiana\/2011\/11\/18\/state-expects-all-indiana-schools-to-earn-as-by-2020\/#annotation\/a38836\" target=\"_blank\">outlines changes to the state&#8217;s rating system for schools<\/a> in language similar to a bill now awaiting a vote in the state legislature.<\/p>\n<p>Republicans have criticized the waivers as part of what they see as a move by the administration to circumvent Congressional authority.<\/p>\n<p>As Mike Petrilli <a href=\"http:\/\/www.educationgadfly.net\/flypaper\/2011\/06\/arnius-duncanus\/\" target=\"_blank\">notes<\/a> on the <em>Flypaper <\/em>blog<em>,<\/em> a spokesperson for a high-ranking GOP representative says some Republicans &#8220;remain concerned about any initiative that would allow [Duncan] to pick winners and losers in the nation\u2019s education system.\u201d<\/p>\n<div id=\"attachment_5071\"  class=\"wp-caption module image right\" style=\"max-width: 300px;\"><a class=\"fancybox\" title=\"President Barack Obama delivers his 2011 State of the Union Address.\" href=\"http:\/\/stateimpact.npr.org\/indiana\/files\/2012\/01\/StateoftheUnion.jpg\" rel=\"\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-5071\" title=\"State of the Union 2011\" src=\"http:\/\/stateimpact.npr.org\/indiana\/files\/2012\/01\/StateoftheUnion-300x199.jpg\" alt=\"\" width=\"300\" height=\"199\" \/><\/a><p class=\"wp-media-credit\">TIM SLOAN\/AFP\/Getty Images<\/p><p class=\"wp-caption-text\">President Barack Obama delivers his 2011 State of the Union Address.<\/p><\/div>\n<h3>Why Waivers Could Be Important For Obama<\/h3>\n<p>Beyond concerns over the implementation of the program, some Republicans have <a href=\"http:\/\/educationnext.org\/obamas-nclb-waivers-are-they-necessary-or-illegal\/\" target=\"_blank\">criticized<\/a> President Obama&#8217;s waiver program as a <a href=\"http:\/\/educationnext.org\/are-nclb-waivers-legal\/\" target=\"_blank\">breech of executive authority<\/a>. But New America&#8217;s Jennifer Cohen points out, the waivers wouldn&#8217;t exist if Congress had already acted to reauthorize NCLB.<\/p>\n<p>&#8220;Offering waivers is the most they can do to get out of some really punitive measures&#8221; in the current law, Cohen tells <em>StateImpact<\/em>.<\/p>\n<p>Cohen says Mr. Obama might consider featuring the waivers in his State of the Union address as an example of acting unilaterally to fill a void of congressional action, although she doesn&#8217;t believe the President will specifically target Republicans \u2014 &#8220;Obama&#8217;s M.O. isn&#8217;t with direct shame,&#8221; Cohen adds.<\/p>\n<p>Aside from the waivers, President Obama could also highlight the competitive grant money his administration offered to states through programs such as &#8220;Race to the Top.&#8221; Both <a href=\"http:\/\/stateimpact.npr.org\/florida\/tag\/race-to-the-top\/\" target=\"_blank\">Florida<\/a> ($700 million) and <a href=\"http:\/\/stateimpact.npr.org\/ohio\/2012\/01\/10\/ohio-one-year-into-race-to-the-top\/\" target=\"_blank\">Ohio<\/a> ($400 million) received grants through the program. Indiana <a href=\"http:\/\/www.ibj.com\/indiana-schools-to-exit-race-to-the-top-competition\/PARAMS\/article\/19493\" target=\"_blank\">withdrew<\/a> its application. Cohen says the administration sees such grant programs as &#8220;quintessential Obama initiatives.&#8221;<\/p>\n<p>But many education policy observers expected an overhaul of the NCLB law &#8220;was the one thing that was going to come out of this Congress,&#8221; Cohen says, which could make the waivers a particularly powerful point for the speech.<\/p>\n<p>On the other hand, <a href=\"http:\/\/scholasticadministrator.typepad.com\/thisweekineducation\/2012\/01\/esea-reauthorization-unlikely-in-2012.html?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+typepad%2Fthisweekineducation+%28This+Week+In+Education%29&amp;utm_content=Google+Reader\" target=\"_blank\">Paul Bruno writes on <em>This Week in Education<\/em><\/a>, NCLB waivers might not be a winning issue for President Obama:<\/p>\n<blockquote><p>Obama is almost certainly worried about re-exciting his base after what have been, for progressives, three often-unsatisfying years.<\/p>\n<p>The progressive educators who should partially constitute his base are already <em>very <\/em>unhappy with Obama&#8217;s Race to the Top and NCLB waiver policies and pushing the administration&#8217;s stated ESEA [&#8220;the Elementary and Secondary Education Act,&#8221; the legal name for NCLB] agenda isn&#8217;t going to assuage their concerns.<\/p><\/blockquote>\n<p><a href=\"http:\/\/blogs.edweek.org\/edweek\/campaign-k-12\/2012\/01\/education_is_one_of_four.html?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+CampaignK-12+%28Education+Week+Blog%3A+Politics+K-12%29&amp;utm_content=Google+Reader\" target=\"_blank\">Alyson Klein at EdWeek<\/a> agrees:<\/p>\n<blockquote><p>President Obama asked Congress to pass a bipartisan reauthorization of the law. But it never happened, and now the administration is moving ahead with a waiver package that Obama&#8217;s own secretary of education thinks is stronger than any of the legislation under consideration. So, if I were a betting woman, I&#8217;d guess there won&#8217;t be much talk about NCLB this time.<\/p><\/blockquote>\n<p>The President will deliver his State of the Union address at 9 p.m. Eastern Time Tuesday.
