A rejected vendor is protesting DOE\u2019s selection of <a href=\"http:\/\/www.hmhco.com\/\">Houghton Mifflin Harcourt<\/a> (HMH) to develop test items and more under the \u201cFlorida Interim Assessment Item Bank and Test Platform.\u201d The funding is provided by a Race to the Top grant from the U.S. government.<\/p>\n<p><a href=\"http:\/\/www.ctb.com\/ctb.com\/control\/main\">CTB\/McGraw-Hill<\/a> contends the state\u2019s negotiation team goofed in their assessment of the bids. DOE issued an <a href=\"http:\/\/myflorida.com\/apps\/vbs\/vbs_www.ad.view_ad?advertisement_key_num=94314\">Invitation to Negotiate<\/a> and received bids from eight vendors. The bids were narrowed down to five companies, then two. CTB and HMH were the two finalists. Now, the rejected company has filed a <a href=\"http:\/\/www.doah.state.fl.us\/DocDoc\/2011\/006256\/11006256_130_12122011_10152437_e.pdf\">formal protest<\/a> with the state. At issue is a contract worth nearly $37 million for HMH.<\/p>\n<p><!--more-->The <a href=\"http:\/\/www.doah.state.fl.us\/ALJ\/searchDOAH\/detail.asp \">filing<\/a> with the <a href=\"http:\/\/www.doah.state.fl.us\/ALJ\/\">Division of Administrative Hearings<\/a> states:<\/p>\n<p><em>CTB\u2019s substantial interests are affected by the proposed agency action because CTB is a responsive and responsible vendor entitled to award of the subject contract. DOE has proposed to award the contract to HMH instead of CTB even though CTB\u2019s proposed solution is the better value.<\/em><\/p>\n<p>In bold letters, CTB contends:<\/p>\n<p><em>The intended decision to award the contract to HMH is contrary to section 287.057 because HMH does not provide the best value to the state.<\/em><\/p>\n<p>The filing goes on to say, \u201cThe conclusions of the Award Recommendation Memo are incorrect.\u201d The document points to presumed inaccuracies relayed to members about the price, system architecture, bandwidth, and ownership of items offered in the bidding. It also says that members changed their votes after the inaccurate or misleading information was presented.<\/p>\n<p>CTB says its offer was approximately $3.5 million less than HMH, and comes with thousands more items. Jim Panos, a senior vice president with HMH, disagrees. He told the <a href=\"http:\/\/www.newsserviceflorida.com\/public\/\">News Service of Florida<\/a> that his company\u2019s bid is the \u201cbest value to the state, and it&#8217;s also best price&#8230; In terms of best value, we absolutely have that.&#8221;<\/p>\n<p>CTB just filed another <a href=\"http:\/\/www.doah.state.fl.us\/DocDoc\/2011\/006256\/11006256_234_12292011_09480274_e.pdf\">request for documents<\/a>.
