State leaders <a href=\"http:\/\/hosted.ap.org\/dynamic\/stories\/F\/FL_SCHOOL_FUNDING_LAWSUIT_FLOL-?SITE=FLTAM&amp;SECTION=STATE&amp;TEMPLATE=DEFAULT&amp;CTIME=2011-11-23-10-26-03\">appealed for a halt<\/a> to the proceedings after a trial judge rejected their request to dismiss the case, but an appellate court voted 8 \u2013 7 this week to allow the lawsuit to proceed.<\/p>\n<p>The lawsuit was filed two years ago by half a dozen students and parents. They were joined in the suit by <a href=\"http:\/\/www.fundeducationnow.org\/  \">Fund Education Now<\/a>, a nonprofit focused on education reform in Florida, and <a href=\"http:\/\/www.yesforalachuaschools.org\/  \">Citizens for Strong Schools<\/a>, a nonprofit based in Alachua County.<\/p>\n<p><!--more-->The plaintiffs say the state is \u201cbreaching its constitutional paramount duty to provide a high quality system of free public schools that allows students to obtain a high quality education.\u201d They claim the defendants \u201chave failed to fulfill their constitutional duties.\u201d<\/p>\n<p>The suit alleges that the state has shifted responsibility for education funding to local governments in violation of the Constitution. It also claims a continued lack of security in schools, and criticizes the state\u2019s use of the <a href=\"http:\/\/fcat.fldoe.org\/fcat\/\">Florida Comprehensive Assessment Test<\/a> (FCAT).<\/p>\n<p>Since the suit was filed in November 2009, there have been some improvements. Florida&#8217;s education system climbed to fifth in the nation, according to the latest <a href=\"http:\/\/www.edweek.org\/ew\/qc\/index.html\">Quality Counts<\/a> report from <a href=\"http:\/\/www.edweek.org\/ew\/index.html\">Education Week<\/a>.<a href=\"http:\/\/afloridapromise.org\/Default.aspx\"> Foundation for Florida\u2019s Future<\/a>, chaired by former Gov. Jeb Bush, touts <a href=\"http:\/\/afloridapromise.org\/PressReleases\/2011\/Foundation_for_Floridas_Future_Applauds_Signing_of_New_Laws_to_Expand_Quality_Education_in_Florida.aspx?page=Default.aspx&amp;pagenum=0&amp;year=2011\">laws signed by Gov. Rick Scott<\/a> this year to expand opportunities for a quality education.<\/p>\n<p>Among other things, the suit seeks a court order forcing the state to craft an education plan that conforms with the Constitution&#8217;s requirements.
