{"id":14678,"date":"2012-11-06T13:29:12","date_gmt":"2012-11-06T18:29:12","guid":{"rendered":"http:\/\/stateimpact.npr.org\/florida\/?p=14678"},"modified":"2012-11-06T13:29:14","modified_gmt":"2012-11-06T18:29:14","slug":"florida-board-wont-appeal-court-ruling-granting-in-state-tuition-to-children-of-undocumented-immigrants","status":"publish","type":"post","link":"https:\/\/stateimpact.npr.org\/florida\/2012\/11\/06\/florida-board-wont-appeal-court-ruling-granting-in-state-tuition-to-children-of-undocumented-immigrants\/","title":{"rendered":"Florida Board Won&#8217;t Appeal Court Ruling Granting In-State Tuition To Children Of Undocumented Immigrants"},"content":{"rendered":"<div id=\"attachment_14679\"  class=\"wp-caption module image left\" style=\"max-width: 299px;\"><a href=\"http:\/\/stateimpact.npr.org\/florida\/2012\/11\/06\/florida-board-wont-appeal-court-ruling-granting-in-state-tuition-to-children-of-undocumented-immigrants\/dream-act-3\/\" rel=\"attachment wp-att-14679\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-14679\" title=\"dream act\" src=\"http:\/\/stateimpact.npr.org\/florida\/files\/2012\/11\/dream-act.jpg\" alt=\"\" width=\"299\" height=\"248\" \/><\/a><p class=\"wp-media-credit\">Florida Immigrant Coalition\/flickr<\/p><p class=\"wp-caption-text\">American-born students whose parents are undocumented will now be able to pay in-state tuition in Florida.<\/p><\/div>\n<p>The State Board of Education will not appeal a <a href=\"http:\/\/www.fldoe.org\/board\/meetings\/2012_11_06\/ruiz.pdf\">court ruling regarding in-state tuition<\/a> for students whose parents are undocumented.<\/p>\n<p>Students previously had to prove their parents were in the country legally in order to qualify for Florida residency status.<\/p>\n<p>Five students sued the state, and <a href=\"http:\/\/stateimpact.npr.org\/florida\/2012\/10\/08\/how-will-the-florida-board-of-education-respond-to-immigrant-tuition-ruling\/\">a judge struck down the rule <\/a>in October.<\/p>\n<p>Without any debate, the Board of Education has agreed to abide by the judge\u2019s ruling.<\/p>\n<p><!--more--><\/p>\n<p>Judy Bone, an attorney for the Board, said &#8220;The order instructs the defendants to notify college presidents, who will send written notification to potentially affected students for the ability to apply for in-state tuition for the spring term.\u201d<\/p>\n<p>The <a href=\"http:\/\/www.splcenter.org\/get-informed\/news\/splc-lawsuit-ends-florida-s-unconstitutional-college-tuition-policy\">Southern Poverty Law Center<\/a> brought the suit on behalf of the plaintiffs and said the ruling could benefit up to up 12,000 students.<\/p>\n<p>At Florida State University, out-of-state students pay $15-thousand more a year than in-state residents.
