Michael Moore agreed that the practice is unconstitutional. He granted the plaintiffs\u2019 motion for summary judgment<\/p>\n<p>The state hasn\u2019t decided <a href=\"http:\/\/www.educationnews.org\/higher-education\/judge-children-of-illegal-immigrants-get-florida-tuition\/\">whether to appeal<\/a>. It&#8217;s waiting for Moore&#8217;s final decision.<\/p>\n<p><!--more--><\/p>\n<p style=\"padding-left: 30px;\">In his initial ruling,<a href=\"http:\/\/law.justia.com\/cases\/federal\/district-courts\/florida\/flsdce\/1:2011cv23776\/388850\/94\"> the judge concluded<\/a>:<\/p>\n<p style=\"padding-left: 30px;\">\u201cDefendants&#8217; additional criteria for determining residency for public post-secondary education purposes classifies Plaintiffs in such a way as to deny Plaintiffs the same benefits and important opportunities as similarly situated individuals by virtue of their parents&#8217; undocumented immigration status.<\/p>\n<p style=\"padding-left: 30px;\">The relationship between Plaintiffs&#8217; residency, their parents&#8217; immigration status, and the State&#8217;s interest in providing quality public post-secondary education is far too tenuous to justify the State&#8217;s regulations and withstand heightened scrutiny.\u201d<\/p>\n<p>The Southern Poverty Law Center, which brought the suit on behalf of the plaintiffs, said data from the U.S. Census and the Pew Hispanic Center shows <a href=\"http:\/\/news.yahoo.com\/u-born-kids-illegal-immigrants-florida-tuition-judge-200945226.html\">the ruling stands to benefit<\/a> up to 12,000 students.<\/p>\n<p><a href=\"http:\/\/www.orlandosentinel.com\/features\/education\/os-florida-colleges-tuition-illegal-immigrants-20121007,0,3339595.story\">The cost to the state<\/a> could be as high as $200 million a year.<\/p>\n<p>Tonight\u2019s meeting begins at 6 p.m.at Hilton Orlando.<\/p>\n<p>The board will meet tomorrow morning at 8 a.m. at Valencia College with a much <a href=\"http:\/\/www.fldoe.org\/board\/meetings\/2012_10_09\/agenda.asp\">longer agenda, including a budget request for $442 million in new technology<\/a>.<\/p>\n<p>The board will also discuss its 2013 legislative agenda. Items include adding a <a href=\"http:\/\/www.fldoe.org\/board\/meetings\/2012_10_09\/leg.pdf\">financial literacy graduation requirement and a school choice bill which could allow charter schools to use empty district facilities<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Florida Board of Education will meet in a closed session this evening in Orlando.
