Gloria Romero helped write the nation&#39;s first parent trigger law.<\/p><\/div>\n<p>A judge has handed parents in a California desert town a major victory in their efforts to force changes at a failing elementary school.<\/p>\n<p>The parents at Desert Trails Elementary in Adelanto are trying to become the first school in the nation to <a href=\"http:\/\/www.washingtonpost.com\/local\/education\/parent-trigger-could-be-pulled-by-calif-parents-who-want-to-take-over-failing-school\/2012\/07\/23\/gJQABaUL5W_story.html\">successfully use a &#8216;parent trigger&#8217; law<\/a>.<\/p>\n<p><a href=\"http:\/\/www.washingtonpost.com\/blogs\/answer-sheet\/post\/a-strange-parent-trigger-court-ruling\/2012\/07\/24\/gJQAJ3c46W_blog.html\">The law says parent can choose how to reform\u00a0<\/a> a low-performing school if a majority of parents sign a petition. They can replace some or all of the staff, turn it into a charter school under private management or even shut it down.<\/p>\n<p><a href=\"http:\/\/stateimpact.npr.org\/florida\/tag\/parent-trigger\/\">A parent trigger bill was hotly contested in the Florida Legislature<\/a> last spring. Jeb Bush &#8212; vow the bill will be back when lawmakers return next year.<\/p>\n<p>They may want to consider what happened in the California case.<\/p>\n<p>Parents at Desert Trails Elementary School in Adelanto signed a petition to convert the school to a charter. But the school board invalidated the signatures of parents who said they had changed their minds about supporting the charter initiative.<\/p>\n<p>After so many signatures were rejected, supporters no longer could claim 50 percent of parents backed the petition.<\/p>\n<p>So, the case went to court.<\/p>\n<p>Here\u2019s the most interesting part: A judge ruled the petition was indeed valid. He said the school board couldn\u2019t reject it because <a href=\"http:\/\/www.latimes.com\/news\/local\/la-me-parent-trigger-20120724,0,4848549.story\">the law doesn\u2019t allow people who signed the petition to change their minds<\/a>.<\/p>\n<p>Once the signature is on the petition, the only way it can come off is if the school board determines it\u2019s not valid.
