Pa. Attorney General Seeks to Dismiss ‘Gag Rule’ Lawsuit

The provision of Act 13 that requires doctors to sign a confidentiality agreement in order to get the contents of frack fluid was challenged by Luzerne County doctor. Due to uncertainty over who would enforce the law, the suit targets the DEP, the PUC and the AG’s office.


The state attorney general on Tuesday sought the dismissal of a lawsuit against her that claims a medical “gag rule” in new natural gas legislation violates a Dallas doctor’s constitutional right to communicate with his patients. Dr. Alfonso Rodriguez filed the civil suit in July against Department of Environmental Protection Secretary Michael Krancer, Public Utility Commission Chairman Robert F. Powelson and state Attorney General Linda Kelly.
